The European Directive (92/43/EEC) on the Conservation of Natural Habitats and Wild Flora and Fauna (the Habitats Directive) protects habitats and species of European nature conservation importance.
The Habitats Directive establishes a network of internationally important sites designated for their ecological status. These are referred to as Natura 2000 sites or European Sites, and comprise Special Areas of Conservation (SACs), Special Protection Areas (SPAs) and Ramsar sites.
Torbay Council was advised by Natural England to assess the potential of the Torquay Harbour Area Action Plan policies for their likely impact on the Lyme Bay and Torbay new Marine candidate Special Area of Conservation (cSAC). Accordingly a Habitats Regulations Assessment Screening Report Annex was published in December 2010, providing six weeks consultation for formal representations.
The Appropriate Assessment (AA) Report follows on from Stage 1 of the Habitats Regulations Assessment (HRA) Screening Report. The AA Report sets out the findings to enable a judgement whether the Torquay Harbour Area Action Plan, either alone or in combination with other plans or projects, will have significant adverse effects on Lyme Bay and Torbay Marine candidate Special Area of Conservation (cSAC).
