The Traffic Management Act 2004 introduced the practice of differential charging for all PCNs issued on or after 31 March 2008. This means that there are now different parking penalties depending on the seriousness of the contravention.
Under the Road Traffic Act 1991 all parking contraventions attracted the same charge. Therefore under this legislation a motorist 5 minutes late back to their vehicle within a car park would be expected to pay the same as someone who parked on a bus stop.
The Traffic Management Act 2004 is designed to be fairer with each parking contravention being categorised as lower or higher rate, depending on its seriousness.
Lower rate contraventions are charged at £50 and higher rate contraventions at £70. This penalty charge is reduced by 50% to £25 and £35 respectively, if it is paid not later than the last day of the period of 14 days beginning with the date on which the PCN was served.

Also detailed is the amount of time a Civil Enforcement Officer will observe a vehicle parked in each contravention before issuing a PCN.
